France: Guilty-by-Association Prosecutions Violate Rights
Improve Criminal Justice Safeguards, Provide Legal Counsel for Terror Suspects
In its effort to fight terrorism, France routinely arrests and prosecutes people for being associated with possible terror suspects, undermining international fair trial standards, Human Rights Watch said in a new report released today.

Preempting Justice
Counterterrorism Laws and Procedures in France
This 84-page report looks at how France uses a vaguely defined ‘terrorism association offense’ to arrest large numbers of people based on minimal evidence. Human Rights Watch documented credible allegations that terrorism suspects are subjected to oppressive questioning in police custody, linked to a policy that delays a suspect’s access to a lawyer. Many suspects go on to spend long periods in pre-trial detention. Human Rights Watch talked to two dozen people caught up in terrorism investigations and trials, and conducted interviews with counterterrorism officials and judicial authorities.

Colombia: 15 Hostages Rescued by Security Forces
Human Rights Watch today welcomed reports that 15 hostages that had been held for several years by the Revolutionary Armed Forces of Colombia (FARC) have been rescued. Human Rights Watch called on the FARC to immediately and unconditionally release hundreds of others still being held.

France should use its upcoming EU presidency to urge Russian compliance with European Court of Human Rights judgments on Chechnya, the International Federation for Human Rights (FIDH), Human Rights Watch, and the League for Human Rights (LHR) said today. Pushing for Russia to respect the European Court’s decisions on Chechen cases should be a top priority in the European Union’s relations with Moscow, Human Rights Watch, FIDH, and LHR said.

Human Rights Watch's Submission to the Human Rights Council
Over the past five years, France has forcibly removed dozens of foreign residents accused of links to terrorism and extremism. Available government figures indicate that 71 individuals described as “Islamic fundamentalists” were forcibly removed from France between September 2001 and September 2006. Fifteen of these were described as imams. Though not a new policy, national security removals now form an integral part of France’s national strategy to counter violent radicalization and recruitment to terrorism.

Government Should Automatically Stop Deportation Proceedings on Appeal
The European Court of Human Rights decision to order France to suspend the deportation of an Algerian is a reminder that France’s expulsion policy may put people in harm’s way, Human Rights Watch said today. On April 23, 2008, the court ordered France to halt Kamel Daoudi’s deportation until it could review the case and issue a final decision on whether or not he could face torture or ill-treatment in Algeria.

This 92-page report examines administrative expulsions of imams and others deemed to foment extremism. It also documents the criminal deportation of persons convicted of terrorism-related offenses. Based on 19 case studies, the report concludes that the procedures lack the necessary guarantees to prevent serious violations of France’s obligations under international human rights law.
