Mohinder Singh

Mohinder Singh describes the alleged abduction of his son by Punjab police on January 14, 1995. His son Jugraj Singh drove a Maruti van as a taxi.

He came to me in the morning at 9:30, and told me there was a problem starting the car, and I said it should be fixed. He left. The police put their car behind him [at the market]. It was blue, and the police car’s number was PCO-42. Police were sitting in it, without uniforms. When he stopped, they kidnapped him and took him, with the Maruti van, straight to Phase 8 police station. There, they tortured him.

On the 16th, Monday, I found out through the newspaper – it had appeared in three papers – that the police had killed two people in an encounter. The papers said there was a white Maruti van without a number. Even though it [Jugraj’s van] had a number: CH01-1967. The police removed the registered number, and said the van had no number.

The police reported they had killed a Kashmiri militant and Sikh militant in an encounter. Mohinder Singh pursued his case in the Punjab & Haryana High Court and the special court of the Central Bureau of Investigation (CBI). The CBI court later clarified that one of the encounter victims was Jugraj Singh.

I ran around to all the politicians and policemen. Because I was familiar with all of them, I met everyone.

I have the full list of all the people I met. The judiciary didn’t give me any justice. India’s judiciary has been finished.

Mohinder Singh pursued the case for 11 years. The CBI special court dismissed the case in February 2006, citing the unreliability of witnesses and the lack of corroboration of events as stated to have occurred by Mohinder Singh.

Is ten years not enough? When all of the proof had been submitted in two years. The CBI created the maximum delay. I personally went and met the CBI director in Delhi and gave him my complaint. He didn’t give me any response. After that, I sent him three reminders. I didn’t get any response. This is India’s state.

[The CBI court] said that whatever the police said is fine, and the petitioner is wrong. The eyewitness who said that they [police] picked up Jugraj Singh in front of his eyes – he’s a liar, I’m a liar. I had 11 witnesses; all of us are liars. The police are truthful. Those who killed him, the killers – they’re truthful! The sufferer, the victim, who withstood so much oppression – he’s a liar. What justice can we get from here?
